President-elect Obama recently said, "If I found out that there werehigh officials who knowingly, consciously broke existing laws,engaged in cover-ups of those crimes with knowledge forefront, then Ithink a basic principle of our Constitution is nobody above the law."Attorney General-designate Eric Holder recently said top BushAdministration officials "authorized the use of torture, approved ofsecret electronic surveillance of American citizens, secretlydetained American citizens without due process of law, denied theWrit of Habeas Corpus to hundreds of accused enemy combatants, andauthorized the use of procedures that both violate international lawand the United States Constitution."
We must now hold them to honor their words of accountability.The Bush administration has refused to investigate its own crimes andPresident Bush may issue blanket pardons before he leaves, indeed wefully expect him to even try to pardon himself. But that is all themore reason why we must keep as much heat as possible on thepotential for real post inauguration prosecutions. No pardon couldpossibly be broad enough to exonerate the entire litany of the crimesof the outgoing White House without itself raising seriousconstitutional questions.
President Obama must appoint a Special Prosecutor - ideally PatrickFitzgerald - to fully investigate these crimes and prosecute thoseresponsible to demonstrate that we are truly a Nation of Laws and noone - including the President - is above the law.
